DMCA Copyright Policy

Nova-Cast LLC (“Nova-Cast,” “NovaCast,” “we,” “us,” or “our”) respects the intellectual property rights of copyright owners and expects users of our website, applications, platforms, and services to respect those rights as well.

This DMCA Copyright Policy describes the procedures Nova-Cast follows when it receives a notification alleging copyright infringement in connection with material or links made available through services operated or controlled by Nova-Cast.

This policy is intended to comply with applicable provisions of the Digital Millennium Copyright Act, including 17 U.S.C. § 512, to the extent those provisions apply to Nova-Cast's services and activities.
 

1. Nova-Cast's Role

Nova-Cast provides online services that may include information, references, directories, pointers, hyperlinks, or other information-location tools that enable users to locate or access content available from third-party sources.

Nova-Cast does not host, upload, store, or maintain the underlying audiovisual content located on independent third-party services merely because Nova-Cast provides a link or other information-location tool that may direct a user to that content.

Where a Nova-Cast service provides a link to a third-party website, server, stream, or other online location, the underlying material may be hosted, stored, transmitted, and controlled by the applicable third party.

The presence of a link or reference through a Nova-Cast service does not, by itself, establish that Nova-Cast owns, operates, controls, licenses, endorses, or is responsible for the underlying third-party material.

Nova-Cast's services may therefore function, in whole or in part, as information-location tools that refer or link users to online locations operated by third parties.
 

2. Copyright Complaints

Nova-Cast takes copyright complaints seriously.

If you are a copyright owner or are authorized to act on behalf of a copyright owner and believe that a Nova-Cast-controlled link, listing, reference, or other information-location tool facilitates access to material that infringes your copyright, you may submit a DMCA notification to Nova-Cast's designated copyright agent.

A copyright complaint should identify the specific Nova-Cast-controlled material, link, listing, reference, or other information-location tool that is the subject of the complaint.

Because Nova-Cast generally does not host the underlying third-party audiovisual material, a complaint concerning the underlying material should also identify the third-party online location where that material is hosted or made available.

Where the allegedly infringing material is located entirely on a third-party service and is not hosted, stored, or controlled by Nova-Cast, the copyright owner may also need to submit a separate copyright complaint directly to the third-party service provider responsible for that material.

4. Requirements for a DMCA Copyright Notification

A notification of claimed copyright infringement should be a written communication containing substantially the information required by 17 U.S.C. § 512(c)(3), as applicable.

To help Nova-Cast process a complaint efficiently, the notification should include:

A. Identification of the Copyrighted Work

Identify the copyrighted work that you claim has been infringed.

If the complaint concerns multiple copyrighted works, you may provide a representative list of those works.

Where possible, provide sufficient information to allow Nova-Cast to understand the nature and scope of the claimed copyright.

B. Identification of the Material or Link

Identify the specific material, link, listing, reference, or other information-location tool that you believe is associated with the alleged infringement.

Provide information reasonably sufficient to permit Nova-Cast to locate the complained-of material or link.

This may include:

• The URL of the relevant Nova-Cast webpage;

• The URL or identifier of the Nova-Cast link or listing;

• The name of the channel, program, event, or other material;

• Screenshots;

• Account or listing information; or

• Other information that reasonably identifies the material at issue.

The U.S. Copyright Office specifically recognizes that a DMCA notification may identify the reference or link to allegedly infringing material when the service provider is functioning as an information-location tool.

C. Contact Information

Provide sufficient information for Nova-Cast to contact you, including:

• Full name;

• Mailing address;

• Telephone number; and

• Email address.

If you are submitting the notice on behalf of a copyright owner, identify the copyright owner and your relationship or authority to act on the owner's behalf.

D. Good-Faith Statement

Include a statement substantially confirming that:

 

I have a good-faith belief that the use of the copyrighted material described in this notification is not authorized by the copyright owner, its agent, or the law.

E. Accuracy and Authority Statement

Include a statement substantially confirming that:

 

I declare that the information contained in this notification is accurate and, under penalty of perjury, that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

F. Signature

The notification must include the physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

These requirements are based on the statutory requirements for a DMCA notification.
 

5. Submission of a DMCA Notification

Electronic submission by email is preferred.

Please include all information described in Section 4 above.

A notification that does not contain sufficient information may not be considered a valid DMCA notification. Where a notification contains sufficient information to identify the copyrighted work, the allegedly infringing material or activity, and the complaining party, Nova-Cast may contact the notifying party or take other reasonable steps to obtain missing information.
 

6. Nova-Cast's Response to Valid Notifications

Upon receipt of a notification that substantially complies with applicable DMCA requirements, Nova-Cast will review the notification.

Where the DMCA applies and Nova-Cast determines that the complaint concerns a link, listing, reference, or other information-location tool within Nova-Cast's control, Nova-Cast may take appropriate action, which may include removing, disabling, restricting, or otherwise modifying access to the identified link or reference.

Nova-Cast will act expeditiously as required by applicable law when the requirements for applicable DMCA protection are satisfied.

The DMCA provides different safe-harbor requirements depending upon the nature of the service provider's activities. Section 512(d), in particular, addresses providers that refer or link users to online locations containing allegedly infringing material through information-location tools.
 

7. Third-Party Hosted Material

Nova-Cast does not ordinarily have the ability to remove material from an independent third-party server merely because Nova-Cast provides a link or reference to that server.

If the underlying material is hosted, stored, transmitted, or controlled by a third party, Nova-Cast may not be able to remove the underlying material itself.

In such circumstances, Nova-Cast may remove or disable the applicable Nova-Cast-controlled link, listing, reference, or other information-location tool where appropriate.

The copyright owner may also need to submit a separate infringement notification to the third-party service provider that actually hosts or controls the underlying material.
 

8. Knowledge of Infringing Activity

Nova-Cast does not have an affirmative obligation under the DMCA to monitor its services for copyright infringement.

However, where applicable law imposes obligations concerning actual knowledge of infringement or awareness of facts or circumstances from which infringing activity is apparent, Nova-Cast will take appropriate action consistent with applicable law.

The U.S. Copyright Office explains that qualifying providers may be required to act when they have actual knowledge or qualifying “red flag” awareness of infringing activity, while the DMCA does not impose a general affirmative monitoring obligation.
 

9. Counter-Notification

If a Nova-Cast-controlled link, listing, reference, or other material has been removed or disabled in response to a DMCA notification, and you believe the removal or disabling occurred as a result of mistake or misidentification, you may submit a DMCA counter-notification.

A counter-notification should include substantially the following:

1. Your physical or electronic signature;

2. Identification of the material or link that was removed or disabled and information concerning where it appeared before removal or disabling;

3. A statement, under penalty of perjury, that you have a good-faith belief that the material or link was removed or disabled as a result of mistake or misidentification;

4. Your name, address, and telephone number;

5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the federal judicial district in which Nova-Cast may be found; and

6. A statement that you will accept service of process from the person who submitted the original notification or that person's authorized agent.

10. Effect of a Counter-Notification

When Nova-Cast receives a counter-notification that substantially complies with applicable DMCA requirements, Nova-Cast may provide the counter-notification to the party that submitted the original copyright complaint.

Where the applicable DMCA procedures require restoration of the material or access, Nova-Cast may restore or re-enable the affected Nova-Cast-controlled link or reference between ten (10) and fourteen (14) business days after receipt of the counter-notification unless Nova-Cast first receives notification that the complaining party has filed an action seeking a court order to restrain the allegedly infringing activity.

Because Nova-Cast generally does not host the underlying third-party material, restoration under this section refers to the Nova-Cast-controlled link, listing, reference, or other information-location tool, and does not mean that Nova-Cast can restore material located on an independent third-party server.

The U.S. Copyright Office identifies the ten-to-fourteen-business-day period in its explanation of the DMCA counter-notification process.
 

11. Repeat Copyright Infringers

Nova-Cast maintains a policy concerning users or account holders who are repeat copyright infringers.

Where appropriate and consistent with applicable law, Nova-Cast may suspend or terminate access to Nova-Cast services for users who repeatedly engage in copyright infringement or who are repeatedly associated with valid copyright infringement complaints.

In determining whether action is appropriate, Nova-Cast may consider:

• The number of copyright complaints;

• The validity and completeness of those complaints;

• The seriousness and nature of the alleged infringement;

• Whether complaints have been withdrawn or resolved;

• Whether the user has submitted valid counter-notifications;

• Whether a court has made a determination concerning the material; and

• Other relevant circumstances.

Nova-Cast reserves the right to terminate or restrict access where appropriate.
 

12. Fraudulent or Abusive Notices

Nova-Cast expects copyright owners and their authorized representatives to submit accurate and truthful information.

A person who knowingly materially misrepresents that material or activity is infringing may be subject to liability under applicable law.

Accordingly, Nova-Cast reserves the right to take appropriate action against persons who repeatedly submit fraudulent, knowingly inaccurate, abusive, or bad-faith copyright complaints.

This does not limit the right of a legitimate copyright owner or authorized representative to submit a good-faith notification.
 

13. Authorization, Licensing, and Other Legal Rights

A copyright complaint should take into account whether the challenged use is authorized by the copyright owner, an authorized licensee, a contract, applicable law, or another legally recognized basis.

If a user believes that it has a license, authorization, permission, or other legal basis permitting the challenged activity, the user may provide relevant information to Nova-Cast.

Nova-Cast may consider such information when evaluating a complaint or counter-notification.

Nothing in this policy is intended to determine whether a particular use constitutes infringement, fair use, licensed use, or another legally authorized use. Nova-Cast reserves the right to rely upon applicable law and competent legal or judicial determinations.
 

14. Copyright Complaints Concerning Third-Party Providers

If a copyright owner believes that the underlying audiovisual content itself is infringing and that content is hosted or transmitted by an independent third-party service, the copyright owner should also consider submitting a copyright complaint directly to that third-party service.

Nova-Cast cannot remove content from a server or service that Nova-Cast does not own or control.

However, where the complaint concerns a link, listing, reference, or other information-location tool controlled by Nova-Cast, Nova-Cast will evaluate the complaint under this policy and applicable law.
 

15. No Admission of Liability

The receipt of a DMCA notification, the removal or disabling of a Nova-Cast-controlled link, or any other action taken under this policy does not constitute an admission by Nova-Cast that the complained-of material infringes copyright or that Nova-Cast is legally responsible for the underlying material.

Nova-Cast may take action to comply with applicable law, protect its services, or preserve its legal rights without admitting liability.
 

16. Privacy and Disclosure

Nova-Cast may retain copyright complaints, counter-notifications, correspondence, and related information as reasonably necessary to administer this policy, comply with applicable law, protect its legal rights, or respond to legal process.

Nova-Cast may disclose information where required by law, court order, subpoena, or other valid legal process.
 

17. Changes to This Policy

Nova-Cast may modify this DMCA Copyright Policy from time to time to reflect changes in applicable law, technology, services, or business practices.

The most current version of this policy will be published on the Nova-Cast website.
