NovaCast Licensing and Content Rights: What We Can Share—and Why Some Details Remain Confidential
A reasonable question for any streaming provider is: Do you have the right to offer this content? NovaCast’s public answer is yes—NovaCast represents its content offering as licensed.
The supporting structure includes contractual relationships and platform arrangements. Counsel has reviewed the underlying IPTV platform agreement, the NovaCast business model and supporting licensing materials. NovaCast has also organized appropriate documentation for controlled review by qualified partners and investors.
Transparency does not require publishing every contract on the open internet. Media and technology agreements routinely contain confidentiality provisions covering counterparties, pricing, economics, technical architecture and other proprietary information. NovaCast will protect those terms and honor applicable nondisclosure obligations.
That distinction is important. We are not saying that the existence of licensing is a secret. We are saying that the confidential agreements and proprietary architecture supporting the service are not public property. Think of the difference between confirming that a restaurant is authorized to operate and demanding publication of every supplier contract, negotiated price and recipe.
NovaCast’s published terms prohibit unlawful copying, recording, retransmission and redistribution. Customers and affiliates also have a responsibility to use and describe the service appropriately.
Serious due diligence deserves serious evidence. NovaCast’s approach is to provide appropriate verification through controlled channels while protecting contractual commitments and intellectual property. Confidentiality should never be used as a substitute for substantiation—but neither should a company be expected to surrender legitimate trade secrets simply because an online commentator demands them.
